This product is reproduced from geospatial information prepared by various land management agencies that operate within the OwlsheadGPS Project Area.

GIS data and product accuracy may vary. They may be developed from sources of differing accuracy, accurate only at certain scales, based on modeling or interpretation, incomplete while being created or revised, etc. Using GIS products for purposes other than those for which they were created may yield inaccurate or misleading results. The Friends of Jawbone makes no expressed or implied warranty, including warranty of merchantability and fitness, with respect to the character, function, or capabilities of the data or their appropriateness for any user’s purposes.

 The Friends of Jawbone reserves the right to correct, update, modify, or replace GIS products based on new inventories, new or revised information, and as required by policy or regulation in conjunction with other federal, state or local public agencies or the public in general. Previous recipients of the products may not be notified unless required by policy or regulation.

Non-Commercial License

OwlsheadGPS grants you a personal, non-commercial, non-exclusive, non-transferable license to access OwlsheadGPS services and data, to download and use the OwlsheadGPS data, and to access the content within the OwlsheadGPS website on an as-is basis according to the Terms.

Use of the Services by you:

1) You agree to use the data only for the purposes that are permitted by the terms or in accordance with any applicable law, regulation, or generally accepted practices or guidelines.
2) Unless you have been specifically permitted to do so in a separate agreement with OwlsheadGPS or Friends of Jawbone, Inc., you agree that you will not reproduce, duplicate, copy, sell, trade or resell OwlsheadGPS Data or any part thereof for any purpose.
3) You agree that you are solely responsible for (and that OwlsheadGPS has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which OwlsheadGPS may suffer) of any such breach.
Without express written permission from Friends of Jawbone, Inc. you must not:
1) Redistribute, sublicense, rent, publish, sell, assign, lease, market, transfer or otherwise make the OwlsheadGPS data or service available to third parties in such a way as circumnavigates OwlsheadGPS.
2) Use the OwlsheadGPS data in any commercial endeavor of any kind including, but not limited to, education, business, governmental, military, or enterprise use of any kind, or any activity which for you or any entity for which or with which you are engaged or act as agent receive(s) or may receive compensation of any kind either directly or indirectly from use of the data in a Product, as Content, or as a service.

Commercial Use

a) Use of the data on OwlsheadGPS pursuant to this licensing agreement is granted strictly for non-commercial personal use of OwlsheadGPS.com.
b) Commercial use constitutes any use of OwlsheadGPS, or the data contained therein, in any endeavor in which you, or any entity for which or with which you are engaged or act as an agent, receives, or may receive, compensation of any kind either directly or indirectly from use of the data in a product, as content, or as a service.
c) In order to obtain a commercial license to use the software in a business, academic, government, military, enterprise or other commercial environment you must purchase a separate license from OwlsheadGPS which you may do by contacting webmaster@foo.com.

You further understand that:

The OHV route data available through OwlsheadGPS was obtained from public land management agencies or their partners. The role of the OwlsheadGPS Project is to convert this data into useable formats and offer it to OHV users via the internet. Any imperfections in the original agency data will likely also exist in the OwlsheadGPS Project.

Many of the OHV routes in the OwlsheadGPS Project cross private as well as public lands. Agencies may have OHV route data for some private lands but only the segments that cross public land are actually designated by agencies for OHV use. For the your convenience, the OwlsheadGPS Project consolidates route segments into contiguous route data. Always obey signs posted by private property owners regarding access.

Many of the routes within the OwlsheadGPS Project have not been field checked for accuracy.  Some route data comes from as long ago as 1985, before the use of GPS technology by land managers. Much of the route data was collected in 2001 and 2002, and some has been collected and corrected since.  Regardless, the user is responsible for staying on the legal OHV trail.

Never rely on GPS devices or data alone.  Always carry and consult printed maps and navigation tools such as a compass.

Navigating the back country in an OHV is an activity with significant risks. Many OHV routes lead to remote and hard-to-find places that are far from help or services. It is always best to travel with more than one vehicle in your party. Always take your cell phone and your identification, including emergency contact information. Dangers can include, but are not limited to: harmful insect and snake bites; vehicle mishaps such as tip-overs, roll-overs, impacts, and breakdowns; mine shafts and prospect holes; road collapse; slips and falls; weather conditions including extreme heat, extreme cold, strong winds and blowing sand, sudden intense and violent rain storms, and lightning strikes; lack of water and food; steep cliffs and unstable and slippery surfaces; contact with spiny and thorny plants; and disorientation and lack of knowledge as to one’s location. You accept entirely these risks when using software or data from the OwlsheadGPS Project.
