Friends of Jawbone, Inc. (“FOJ”) respects your right to privacy and shares your concern about the security of any information you may submit to FOJ. FOJ’s Online Privacy Statement (the “Policy”) covers the collection, use, and disclosure of personal information that may be collected by FOJ when you visit this website (www.OwlsheadGPS.com) (the “Site”). This Policy does not address our practices regarding information that we collect through our products or applications, or when you interact with our support personnel. Please take a moment to read the following to learn more about our information practices, including what type of information is gathered on our Site, how the information is used and for what purposes, to whom we disclose the information, and how we safeguard your personal information.

For individuals who provide information online to our affiliates in the European Economic Area (“EEA”), our affiliates may share such information with FOJ in the United States. FOJ abides by the Safe Harbor frameworks agreed to by the U.S. Department of Commerce and the European Union (EU) and the Federal Data Protection and Information Commissioner of Switzerland with respect to personal information collected by entities located in the EEA and Switzerland and transferred to FOJ in the United States. What information about me does FOJ collect?
Personal Information. FOJ collects personal information only if you voluntarily choose to share such information with FOJ. You may browse the Site without disclosing any personal information. However, in order for you to take advantage of particular opportunities provided through the Site (for example, to sign up for a newsletter or to view certain areas of the Site), we may require that you furnish personal information.

When you set up an account, sign up for newsletters or participate in surveys, FOJ collects personal information such as your name, address, and files that you download.

If you place an order at www.jawbone.org FOJ will request and collect personal information such as your name, e-mail address, mailing address, telephone number, and credit card information.

You also may decide to send FOJ personally identifying information in an e-mail message which might contain information or inquiries about FOJ’s products or services.

There are several other opportunities for you to share personal information about yourself with FOJ on the Site. This may include information about you such as your interests, your name, and your mailing address and e-mail address. Submission of this information is strictly voluntary.

Anonymous or Aggregated Data. FOJ collects and stores certain data about the use of FOJ’s Site. This is done on an anonymous basis, and the same information is collected for all hits on FOJ’s servers. The information collected may include the time and date you visited the site, the pages at which you looked and domain name. FOJ does not link this information to anything personally identifiable to you. FOJ only uses this information for system administration and to help FOJ develop ideas about how it might tailor its site to improve your visit.

Cookies and Other Technologies. We use cookies while you are on our Site. Cookies are small text files that help FOJ keep track of your shopping cart and other movements within our Site, and they only contain the necessary information to associate a shipping ID on your computer with the orders in the “shopping cart” table on FOJ’s server and other navigational information to help you move through our Site. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular web site, to your computer

Please note: At the present time, you cannot purchase from www.jawbone.org with the “cookies” feature shut off on your browser. We do not tie personally identifiable information to our cookies.

We and our service providers may also use “pixel tags,” “web beacons,” “clear GIFs,” or similar means in connection with Site pages and HTML-formatted e-mail messages to, among other things, track the actions of Site users and e-mail recipients, to determine the success of marketing campaigns and to compile aggregate statistics about Site usage and response rates. We may also engage one or more third party service providers to serve online advertisements on our behalf. They may use a “pixel tag” to collect anonymous information about your visits to this Site and to other websites, and they may use that information to target advertisements for goods and services. This information is collected anonymously, in a manner that does not personally identify you. IP Address. When you visit and interact with the Site, FOJ and third parties with whom FOJ has contracted to provide services to FOJ may collect IP Addresses. Your Internet Protocol (IP) address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited.

How does FOJ use information about me?
Fulfillment of Requests. FOJ may use personal information about you to fulfill requests made by you such as to respond to your email inquiry, fill your order or add you to our mailing list.

Purchases. When you make a purchase through the Site, we may collect your credit card number or other payment account number, billing address and other information related to such purchase from you, and may use such information in order to fulfill your purchase.

Administrative or Transactional Communications. From time to time, we may use personal information about you to send to you important information regarding the Site, changes to our terms, conditions, and policies and/or other administrative or transactional information. Because this information may be important to your use of the Site, you may not opt-out of receiving such communications.

Other Communications. If you choose to share any personal information with FOJ, FOJ may store it and use it for marketing purposes, including e-mailing you with special promotions and other programs of interest. FOJ may also, in the event that this information is collected as part of a warranty registration process, use this information to contact you later for matters relating to your product or service. If the information is sent as part of a Site evaluation, FOJ may also use the information to contact you about your comments. Testimonials. As you are informed prior to submitting testimonials or stories to us through the Site, we may make such information public or use such information in our promotional materials.

E-mails to Friends. We may provide functionality to permit you to send messages regarding Site-related content to a friend through the Site. If you wish to use this feature, you may be required to provide us with, and we may use, your friend’s e-mail address so that we can facilitate your sending of such message to your friend. Please make sure that you have the right to submit your friend’s email to us. We will not use your friend’s information other than to facilitate your sending of this one time message

Promotions. We may operate sweepstakes, contests and similar promotions (collectively, “Promotions”) through the Site. We typically ask you for certain personal information when you enter and, if applicable, win a Promotion. We will use your email address to contact winners. You should carefully review the rules, if any, of each Promotion in which you participate through the Site, as they may contain additional important information about Company’s use of personal information about you. To the extent that the terms and conditions of the Promotion rules concerning the treatment of personal information about you conflict with this Policy, the terms and conditions of the Promotion rules shall control.

Internal Business Purposes. We may also use personal information about you for our internal business purposes, such as data analysis, audits, order fulfillment, workflow planning and other similar purposes.

Compliance with Applicable Law. We may need to collect and retain personal about you in order to comply with applicable laws and to respond to requests from public authorities, including public authorities outside your country of residence.

How does FOJ disclose information about me?
Third Party Agents and Service Providers. We work with third party agents and service providers who provide services including but not limited to administration of the online functions on www.OwlsheadGPS.com, data analysis, payment processing, order fulfillment and other services of an administrative nature. We may share personal information about you with third parties for the purpose of enabling these third parties to provide these types of services (for example, if you choose to make a purchase through the Site, we may share personal information with our third party service providers to fulfill your purchase, including, without limitation, to process your credit card or payment account number or to ship products to you). FOJ requires that its agents and service providers that have access to personal information properly safeguard that personal information and use it only for the purpose that it was collected and not for their own promotional marketing. For personal information received from the EEA and Switzerland, FOJ requires that service providers either subscribe to the Safe Harbor Principles or are subject to the EU Privacy Member State law or another adequacy finding or enter into a written agreement with us that requires them to provide at least the same level of privacy protection as is required by the relevant Safe Harbor Principles.

Strategic Partners and Co-Branded Pages. From time to time, we may enter into a special relationship with another company that is not owned by or affiliated with FOJ to provide additional features on the Site. These special relationships may include co-branded sites (“co-branded pages”). Any information, including personal information, that you provide on one of these co-branded pages, will be shared with these strategic partners. By providing your information on these co-branded pages, you also consent to our providing personal information about you to those third parties. However, please note that as third parties generally use personal information about you in accordance with their own privacy practices, you should check these third parties’ web sites for information regarding their privacy practices. PLEASE NOTE THAT THIS PRIVACY STATEMENT DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY THIRD PARTIES. If you do not want personal information about you shared with such third parties, please do not provide personal information on pages that are co-branded with third parties.

E-mails to Friends. Please note that any personal information you provide in connection with sending messages regarding Site-related content to a friend through the Site, such as your name and your e-mail address, will, of course, be disclosed to your friend.

Promotions. We may share the personal information you provide in connection with Promotions with third party sponsors of such Promotions (irrespective of whether such Promotions are hosted by us), or otherwise in accordance with the rules applicable to such Promotion. You should carefully review the rules, if any, of each Promotion in which you participate through the Site, as they may contain additional important information about a sponsor’s or other third party’s’ use of personal information about you. To the extent that the terms and conditions of such rules concerning the treatment of personal information about you conflict with this Policy, the terms and conditions of such rules shall control.

Information Posted by Visitors. FOJ may make available through the Site services (for example, message boards, forums, chat functionality and blogs, among other services) to which you are able to post information and materials. Please note that any information you disclose through such services or otherwise on the Site becomes public information, and may be available to visitors to the Site and to the general public. We urge you to exercise discretion and caution when deciding to disclose personal information, or any other information, on the Site. WE ARE NOT RESPONSIBLE FOR THE USE OF ANY PERSONAL INFORMATION YOU VOLUNTARILY DISCLOSE THROUGH THE SITE.

Testimonial Copy. If you submit a story or testimonial to FOJ via webmaster@jawbone.org, we may make those comments public or incorporate them into our promotional materials. You will receive an automated response if you send a story or testimonial to webmaster@jawbone.org telling you what to do if you do not want FOJ to make your story or testimonial public or incorporate it into our promotional materials.

Assignment. We may transfer any and all information that we collect from Site users to a FOJ affiliate or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of FOJ’s business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings). In those circumstances, for personal information received from the EU, FOJ will seek to ensure that the acquiring entity continues to protect the personal information in accordance with the Safe Harbor Principles or that the personal information be deleted.

In addition, FOJ may share your personal information with third parties:

1. FOJ determines that it is required to do so by law or to comply with legal process;

2. to respond to a request from the government or another public authority;

3. to assist or support a third party’s theft investigation involving FOJ GPS units or a third party’s theft prevention efforts relating to GPS products;

4. to enforce our terms and conditions or any of our policies or usage guidelines for specific products or services;

5. it is necessary in FOJ’s opinion to do so to prevent, investigate, detect or prosecute criminal offences or attacks on the technical integrity of FOJ’s site(s) or its network;

6. it is necessary in FOJ’s opinion to do so to protect the rights, privacy, property, or safety of FOJ or its employees, FOJ affiliates, the users of its Site, or the public;

7. to permit us to pursue available remedies or limit the damages that we may sustain; or

8. if FOJ has your consent.

FOJ does not share, rent or sell your information to another company in ways other than disclosed in this privacy statement.

What does FOJ do to protect the data transmitted to FOJ through the Site?
We will take the appropriate legal, organizational, and technical measures to protect personal information to protect personal information, including sensitive information such as credit card information, from loss, misuse and unauthorized access, disclosure, alteration and destruction. For example, FOJ’s online store, www.jawbone.org, uses industry standard Secure Sockets Layer (SSL) technology that protects information while it is being transmitted between your computer and FOJ’s servers. FOJ engages a company that is an industry leader in online security and site verification to test the security of FOJ’s site. FOJ’s Site www.jawbone.org is also registered with site identification authorities so that your browser can confirm FOJ’s identity before any personal information is sent. In addition, FOJ protects personal information using firewall technology.

However, regardless of the effectiveness of our security measures, no security system is impenetrable. We ask that you do your part by, at a minimum, keeping any computer passwords you use to access the Internet strictly confidential. If at any time you believe that your interaction with the Site is no longer secure, please let us know as soon as possible.

Linked Sites and Third Party Software.
For your convenience, FOJ may include links to third party sites. You should carefully review security/privacy policies of any third party sites accessible from FOJ’s site. Other sites accessible through FOJ’s Site have their own policies and data collection, use, and disclosure practices. Please consult each site’s policies and practice. FOJ is not responsible for the policies or practices of third parties. The information practices of those websites linked from FOJ’s Site are not covered by this Privacy/Security Policy. These other sites may send their own cookies to users, collect data, or solicit personal information.

If you choose to download third party software applications onto your FOJ product, you should read carefully the terms of use for such software applications and the privacy statements of such third parties. FOJ is not responsible for the collection, use or disclosure of any information you share with any such third parties.

Does FOJ offer opt-outs relating to marketing?
If and when you create an OwlsheadGPS.com account you will be presented with the opportunity to receive (opt-in) marketing-related emails from FOJ and from our select third party partners. If you no longer wish to receive the marketing-related emails you’ve requested from us, you may opt out of receiving these emails by following the unsubscribe instructions within each email communication or by logging into your OwlsheadGPS.com account and changing your email preferences.

You may also send us an email at webmaster@jawbone.org. Please specify clearly which of the following choices you are opting out of:

• Receiving marketing-related emails from FOJ; and/or

• Allowing FOJ to share PII about you with third parties for their marketing purposes.

Please note that if you opt out as described above, we will not be able to remove PII about you from the databases of third parties with which we have already shared PII about you (i.e., third parties to which we have already provided PII about you as of the date on which we implement your opt-out request). If you wish to cease receiving marketing-related emails from such third parties, please contact those third parties directly, or utilize any opt-out mechanisms set forth in their respective privacy policies or marketing-related emails.

Special Notification for California Residents — Your Privacy Rights. Individual customers who reside in California and have provided personal information to FOJ may request information about FOJ’s disclosures of certain categories of personal information to third parties for their direct marketing purposes. Such requests must be submitted to us at the address listed in below. This request may be made no more than once per calendar year.

How can I access or change information about me?
If you would like to request access to personal information about you or if you would like to request that FOJ correct, amend, suppress or delete personal information through this Site please contact FOJ at webmaster@jawbone.org. FOJ will respond to your request for access within 30 days. Please note, however, that certain personal information may be exempt from such access, correction, objection, suppression or deletion rights pursuant to applicable data protection laws or the EU/US Safe Harbor.

What is FOJ’s policy regarding children’s use of FOJ’s Site?
While FOJ encourages everyone to visit its website and learn about the organization and GPS technology and applications, FOJ has no desire to collect information from those under the age of 18. Any instance of personal information about a minor being collected would be purely accidental and unintentional. If a minor would like to submit information to FOJ, FOJ asks that the child’s parent submit the information on his or her behalf. FOJ strongly encourages parents to take an active role in their children’s use of the Internet and to take appropriate steps to ensure a positive and safe experience.

Data Retention and Integrity
We will retain personal information about you for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required by law and/or regulations. We also take reasonable steps to ensure that personal information we process is reliable for its intended use, accurate, and complete as necessary to carry out the purposes described in this Policy.

Privacy/Security Policy Changes
If FOJ makes changes to this Policy, these changes will be posted on FOJ’s Site in a timely manner. If FOJ decides to materially change its privacy policy, it will post those changes to this privacy statement and other places FOJ deems appropriate, including the home page on the Site, so that you are aware of what information FOJ collects, how FOJ uses it, and under what circumstances, if any, FOJ discloses it. FOJ reserves the right to modify this privacy statement at any time, consistent with the requirements of the Safe Harbor, so please review it frequently. You can determine when this Policy was last revised by referring to the “Last Updated” legend at the top of this page. Any changes to this Policy will become effective upon our posting of the revised Policy on the Site. Use of the Site following such changes constitutes your acceptance of the revised Policy then in effect.

Jurisdictional Issues
The Site is controlled and operated by FOJ from the United States. FOJ does not represent or warrant that the Site, or any part thereof, is appropriate or available for use in any particular jurisdiction. Those who choose to access the Site do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations. We may limit the Site’s availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion.
